Can't think of a time when I have heard a lawyer discussing platform liability use the phrase "the 26 words."

Don't know why they would. Easier to just say "two thirty."

There are countries where hate speech is regulated just like speech in this country. There is no such thing as free speech. Fire in the theater. We could develop a body of Law and model it on those successes

Hate speech is regulated in many countries democracies in the world, and as far as I can tell, it does not impair or impede free speech. Unlike some other kinds of speech, this is not difficult to classify.

Pretty amazing that 60 Minutes does an entire segment about Germany prosecuting people for online posts and does not include even one voice raising free speech concerns. The segment looks like it was produced by the German government. www.cbsnews.com/news/policin...

In the U.S., most of what we say online, even if it's hate filled, is protected by the First Amendment as free speech. But in Germany, prosecutors and cops police the internet.

This opinion gives a roadmap for any future court to accept national security or privacy as a pretext for laws and actions that are intended to limit speech (as the bill’s supporters readily admitted).

I do not think that tomorrow’s likely shutdown of TikTok will affect the company’s decision to seek cert. This is a liability for TikTok regardless of the app’s future in the US.

There is another important TikTok case at SCOTUS. TikTok likely will file a cert petition in Anderson v. TikTok, a Third Circuit opinion that narrowly construed Section 230. TikTok has retained Paul Clement and received an extension to file until Feb. 20.
