Another point missing in this essay is the lack of reference to the theory of criminal Justice imported from Germany after 9/11. Just one author change the entire perspective on the field. By the way the fascist lawyer love the so-called “Enemy Penology” (Feindstrafrecht). Jakobs is the new Schmitt.

The only very important point the essay explain is the use of administrative acts instead of statutory law (revealing the impotence of the legislative) to govern a country. Fascist law can be explain by analyzing this moment of transition from formal/rational statutory law to mere “decisions”

Disappointing (!) the importance of law in a prerogative state (Fraenkl), political Justice (Kirchheimer) and the change in the function of statutes in law (Neumann) are the minimum standards to examine the phase of any country when the rule of law and democracy are in peril of been dismantled.

I would like to think that this is not a joke or just somebody trying to troll like the behavior in X (Twitter). So, taking you seriously I would argue to separate answers: 1. Anti-fascism have the anti prefix meaning opposed to, meaning oppose to fascism. 2. Fascism is the opposite to Democracy.
