Isnt this sort of lethal force used in the ‘war on drugs’ exactly what former pres duterte is charged with before the international criminal court? Could trump find himself in a similar position?
Thanks to prof manfred nowak for this slide on criminal leaders of states around the world including duterte, netanyahu, putin, bolsonaro, and trump
Closing panel now on at AHRI hosted by PUCP in lima on human rights and organised crime with elizabeth salmon, maria pulido, manfred nowak and frans viljoen. Its been such a great conference!
Jose: we have a saying here that ‘When fear comes in the door, law goes out the window’. He refers to populist leaders and their attempts to be tough on crime at the expense of human rights law.
Saul argues that terrorism should be countered while respecting human rights, not just because of their legal force, but because it makes their counter-terrorism efforts more effective in practice
Great response by jose ugaz who sets out the peruvian experience of organised crime and the political elements of it. He also highlights corruption as key activity of organised crime groups
Private violence by organised crime is done for profit; whereas terrorism is public violence for poltical, religious or ideological purposes. Designating something as terrorist gives a state more scope/power to address it. But Does it matter to the victim what the purpose of the violence was?
Ben saul sets out differences between organised crime and terrorism but also their overlap. For example sometimes terrorist groups who are politically motivated engage in crime to raise money to fund their activities.
Antoine buyse director of SIM presented at AHRI his work at @utrechtuniversity.bsky.social on elaborating the universal declaration of human rights with our law students
