The one-year cutoff is calculated, to the day, to hold California's redistricting law inapplicable to the '26 races -- because it was passed 364 days before the Nov 3 election next year.

One day shy. How ... perfect.

Texas is the only state the court will allow to redistrict before the election.
#BREAKING: Over dissents from the three democratic appointees, #SCOTUS puts Texas's new House maps back into effect for (and, presumably, through) the 2026 midterms.

The three Democratic appointees, in an opinion by Justice Kagan, dissent.

I'll post the ruling shortly.

(I love a fine detail, so appending an asterisk to that "6–3" to say that it's *possible* it was 5–4. All we know is that only 3 signed their names to Kagan's dissent—but you can vote no without signing on to a dissent.)(Thanks for the nudge, @proptermalone.bsky.social!)

I think you may be missing the fact that there's a distinction between "dissenting" (on the court's vote on whether to grant a stay) and "writing a dissent" (which on the shadow docket is a purely optional exercise, done only if one feels compelled). The shadow docket is a little different.

The fact that both the unsigned 6–3 majority opinion and Alito's concurrence (for Alito, Thomas, and Gorsuch) open with a reference to California's redistricting leaves one with the strong impression that this decision, like California's, is about tit for tat.

I realized long ago that a fundamental tenet of the Federalist Society has always been that facts are irrelevant to law and lawsuits.

What matters is using cases to rewrite the Constitution and federal statutes. And, if necessary in order to do that, the facts.
Anyway, I'm no grand scholar of the judiciary, and all of this is just my own two cents and perhaps I'm overreading the extent to which the lower courts are going to be upset, but as someone who cares deeply about *facts,* I'm mostly just frustrated about the extent to which this Court doesn't.

As a former fed clerk who had many high profile cases, it’s just so disheartening to actually do law and then for an appellate court to ignore your record and make up new facts predicated on vibes seen on cable television.

Particularly for PIs. Reagan appointees are working til midnight!

THIS:
It's good—very good, and very important—that district courts keep issuing these 100-page rulings upholding the law. It must be incredibly dispiriting to see them overturned in a two-page, lawless, unsigned order, but please, keep them coming. They expose SCOTUS' corruption like nothing else.

With Trump and his Putin loving cronies, Macron is effing spot on:

"“There is a chance that the US will betray Ukraine on territory without clarity on security guarantees,” Macron said according to the English language notes of the call that DER SPIEGEL has obtained."
"We Must Not Leave Ukraine and Volodymyr Alone with These Guys"
DER SPIEGEL has obtained notes from a conference call involving EU leaders - including Germany's Friedrich Merz and France's Emmanuel Macron - showing just how little trust Europe has in Washington.

Without evidence, Prasad claimed COVID-19 vaccines have killed 10 children in the US, and announced unilateral, sweeping changes to the way the agency regulates and approves vaccines, including seasonal flu shots.

A dozen former FDA chiefs say that's deeply stupid.

Hey, y'all, MY post is sarcasm, too!! Just like the post I was posting to.
Soooo ... you're saying they *weren't* headed to the US - even "theoretically" - and Hegseth and Bradley knew that, given the size and type of their boat?

They're destroying boats they know are way too far from the US to be headed here, saying they're keeping them from arriving here with drugs??!

Clearly they were trying to overturn their capsized cigarette boat to continue on their trajectory of delivering drugs when the gas tank capacity of such a boat would only make it 1/5 of the way from Venezuela to America.
