The Issues Paper for the Australian Law Reform Commission’s Review of Surrogacy Laws has been published today. The Issues Paper provides a broad overview of the Inquiry, suggests principles and approaches for the Inquiry, and invites input from stakeholders and the public.

The paper asks for input on issues including: principles that should guide law reform in this area; donation of tissue by living persons and after death; anatomical and post-mortem examinations; advertising and trade in human tissue; and allocation of donated human tissue.

The Inquiry has to date conducted 60+ consultations with 200+ consultees, received 40+ submissions, held 2 Advisory Committee meetings, and the ALRC team has attended events around the country to discuss the Inquiry. The ALRC is due to provide its final report to the Government by 8 December 2025.
