Proposed Federal Rule of Evidence 707 is the FRE's first response to the "AI Era." It would be a good first step, but there's much more to work yet to be done.

I just bought this photo, simply labeled "Old Judges," at an estate sale for $3.

Little did the seller know that it's actually an original, official portrait of the Fuller Court from its Lochner term. That means, if my calculations are correct, I'm looking at an appraisal value of *at least* $7.

The entire article is fascinating! Particularly if you're interested in the gradual demise of Langdellian formalism and the initial emergence of realists such as Holmes, Frank, Llewellyn, Pound, Cohen, and the like.

That’s the general sentiment. At least, AI seems to use em-dashes much more frequently than the general public, so the association’s stuck quickly.

It’s unfortunate, too, because I have yet to see an AI produce anything close to expert-level academic writing. But em-dashes still have the stigma.

One of the more trivial annoyances I have with AI is the widespread skepticism it’s brought to em-dashes.

I love em-dashes! I’ve used them liberally in my articles for a decade.

But now, I avoid them when writing, given their association. Not the worst consequence of AI, of course, but a bummer.

Yep, I also found it to be a particularly noticeable issue. I had a T20 offer in early February, and only one journal responded to my expedite. I totally sympathize with journals having to juggle a million items at once, but I hope ghosting doesn't become (more of) a norm.
