I'm Adam, and I represent and counsel video game studios, devs, and UGC creators on all sorts of matters, including IP and contract issues. I've been particularly active in the Roblox space.

Another big UGC acquisition! @Geerzy just sold The Pit to @GaijinEnt in a “multi-million-dollar deal."

I expect to see a lot more of these! I was approached by multiple cos at GDC this year, wanting to spend hundreds of millions on Roblox games and studio acquisitions!

The fastest way to remove a stolen game on Roblox is with a DMCA notice. You don’t need a lawyer to do that.

Step 1: 1️⃣ Paste the URL where your game is hosted.
Step 2: 2️⃣ Paste the URL of the infringing game.
Step 3: 3️⃣ Describe the infringement, e.g., “The infringing game has made a 1:1 copy of my game’s thumbnail.”
2/x Let’s say someone steals your game thumbnail, and now they’re siphoning off players that should be on your game. The fastest way to fight back is to file a DMCA notice with Roblox.

5/ If Section 230 Communications Decency Act didn't exist, platforms like Roblox could be sued for everything its users create. Without this protection, there would be no UGC. Just safe, sanitized, boring, corporate-approved content.
4/ But Roblox pushed back hard. They argued two things:

1️⃣ Section 230 — that’s the law saying platforms aren’t responsible for user-created content.

2️⃣ And free speech — that their tools and platform are protected under the First Amendment.

🧑‍⚖️ The court agreed and dismissed the case early.
3/ They argued that games were designed to cause "internet gaming disorder," and that companies should be legally responsible for that.
2/A group of parents sued Roblox, along with Nintendo, Sony, Rockstar, and others, claiming their games were intentionally addictive, kind of like the lawsuits against Big Tobacco.

5/So, at least for now, Roblox isn’t legally responsible for your Roblox addiction.

My guess is that it may take another opinion or two like this before plaintiffs' lawyers move on to another target.
4/The court found that:

➡️ Roblox’s own content, including its game creation tools, is protected expression under the First Amendment.

➡️Under Section 230, Roblox is not liable for content created by its users.
3/ Roblox responded by moving to dismiss the case, citing Section 230 of the Communications Decency Act and First Amendment protections.

Last week, the court agreed, granting Roblox’s motion to dismiss.
2/ The legal strategy borrowed the approach used in the tobacco litigation, aiming to hold companies accountable for addictive designs.

If successful, it could have opened the floodgates to a wave of lawsuits against the gaming industry.
