Democrats should be drawing up legislation right now, this very minute, to bar Trump from helping himself to $230 million in taxpayer funds from DOJ. Challenge Republicans to hold a vote on it. Push this so hard in the media that every GOP Senate and House candidate is pressed to comment on it.

It has to be likely to provoke imminent and specific violence. "Go shoot that officer" said to a man holding a gun - not protected. "Someone needs to shoot our oppressors" to a crowd - probably protected.

Don't take my word for it. It's black letter law. Look it up.

You are threatening to prosecute a citizen for exercising his 1st Amendment rights.

His invocation to shoot ICE agents may be offensive, but it is not intended nor likely to produce imminent, lawless action. Per Brandenburg v. Ohio, this is protected speech.

Please learn the law, DHS.

DHS is threatening prosecution of this man for speech protected by the 1st Amendment.

Some may find his words offensive. However, since they are not likely to produce imminent, lawless action against a specific target, they are lawful per Brandenburg v. Ohio.
