Ah, so interesting. So is it your assessment that the obligation to preserve attaches to the role someone is performing, legitimately or not? Or does it attach to the source of the information ( eg protected fed grand jury testimony)?

🚨ALERT: there are 3 ICE / US Park Police vehicles stopped on BW Parkway near Cheverly. Park police can do traffic stops on BW Parkway between Baltimore & DC and are actively collaborating with ICE.

WARNING: Commercial vehicles are not allowed on the parkway & are therefore at higher risk for stops.
I think in her case the accountability is going to be in getting kicked back to being a Trump lawyer, humiliated and probably unemployable in the future.

Seems like a good question, but then where would it end? If LH turns out to be illegally appointed, and she sends grand jury info to Bower, and Bower publishes on Lawfare and Bluesky hosts the Lawfare account and I forward said Lawfare post to MY brother—are we all subject to presidential records?
Sure, of course. But if somebody wants to litigate her failure re the records act—which I very much doubt anyone will given the volume of major crimes in this administration—she has this Not-actually-legit US attorney card to play. Esp since everything else she’s done in office would be unwound.

Because the presidential records act would apply to actual presidential records, but if she wasn’t a legitimate employee, her comms wouldn’t be subject to it. It just seems an argument she could use in court. But originally I was just joking, anyway, about her likely disappearance from the scene.

There’s a whole thing about how she was illegally appointed after the temporary/interim 120 days the president gets had expired. In the Comey filing?
I mean she can’t be adjudicated for breaking the records act if her whole tenure as prosecutor was illegitimate? That is, she’ll get kicked to the curb but her criminal stupidities while occupying the job she didn’t really occupy won’t matter? Maybe I’m wrong.
Well luckily she’s not actually a legit appointee so she’ll get out of it.
