There are two Virginia homes, one involving a niece and one involving a grand-niece. The home that is the subject of the indictment is one James bought in 2020. Her grand-niece & family reportedly live there.

Back in 2020, James did disclose a small sum collected in rent (between $1,000-$5,000) on her NY ethics forms. That she at one point years ago collected a small sum in rent (allowed by the contract) is not inconsistent with the idea that her grand niece has lived there for years w/o paying rent.

This is important exculpatory evidence bc the indictment accuses James of seeking a “second home” mortgage when in reality she intended to use it as an “investment” home by renting it out.

(James disclosed between $1,000-5,000 in rent during 1st year, but the contract allowed short term rentals.)

Bystander filming asks man for his name. ICE agent lies and says he’s not allowed to speak to him “by law” and another says “We’ve arrested American citizens for being too close…If he gets any closer, put him in cuffs.”

NEW: In Kilmar Abrego Garcia's criminal case, his defense team files a motion to suppress statements he made to HSI agents after he was taken into custody by ICE on March 12, 2025.

Shortly after the interview, Abrego was wrongly removed to El Salvador.

PRELIMINARY STATEMENT
On March 12, 2025, agents from the Department of Homeland Security ("DHS") "seized
Abrego I] without any lawful authority." Abrego Garcia v. Noem, 777 F. Supp. 3d 501, 519 (D.
Md. 2025). Mr. Abrego was taken to an Immigration and Customs Enforcement ("ICE") field
office, where federal agents interviewed him in connection with an investigation into suspected
human smuggling without properly advising him of his Miranda rights and without a translator
present. A few days later, DHS unlawfully removed Mr. Abrego to El Salvador.
The government's conduct on March 12 violated Mr. Abrego's Fourth and Fifth
Amendment rights. Because of this flagrant abuse of law enforcement authority, we move to
suppress the statements that Mr. Abrego made to law enforcement when he was unlawfully
arrested and detained.
BACKGROUND
Mr. Abrego's Arrest on March 12, 2025
When the government arrested Mr. Abrego on March 12, 2025, prior to removing him to
El Salvador, he was lawfully living and working in Maryland. See Abrego Garcia v. Noem, No.
25 Civ. 951, 2025 WL 2062203, at *3 (D. Md. July 23, 2025). In 2019, Mr. Abrego secured an
order from an immigration court granting him withholding of removal to El Salvador. (D. Md.
Am. Compl. 19 1, 48, 70-72; see also Compl. Ex. B).' The government never appealed the
withholding decision, nor did it seek to remove him to a third country at the time. Id.; see 8 C.F.R.

Whoa, Judge Perry says the Feds’ declarations about unrest at ICE facilities are not credible because some of the incidents they cite in their declarations were separately no-billed by grand juries
The Court therefore must make a credibility assessment as to which version of the facts
should be believed. While the Court does not doubt that there have been acts of vandalism, civil
disobedience, and even assaults on federal agents, the Court cannot conclude that Defendants' declarations are reliable. Two of Defendants' declarations refer to arrests made on September 27,
2025 of individuals who were carrying weapons and assaulting federal agents. See Doc. 62-2 at
19; Doc. 62-4 at 5. But neither declaration discloses that federal grand juries have refused to
