LFJL also welcomes the Deputy Prosecutor’s confirmation that civil society in and outside Libya is vital to support the Court’s work in Libya, and must be protected from threats and reprisals.

For this to be meaningful for victims and Libyan society, the Court must ensure that his prosecution in The Hague contributes to accountability and justice in Libya.

LFJL calls on Libya to move beyond rhetoric and to stop treating the UPR as a formal exercise but as a meaningful opportunity to advance human rights in Libya. This requires going beyond merely accepting recommendations and to begin their concrete implementation,

A long list of recommendations on protecting civic space, revising restrictive laws and safeguarding journalists and civil society actors were also repeated, confirming that Libya has not acted on earlier promises to improve freedoms of expression, association and peaceful assembly.

States once again urged Libya to end arbitrary detention, close unlawful detention centres and prevent torture, showing that earlier commitments on detention practices were not implemented.

The recommendations illustrate the depth of international concern over long-standing human rights challenges in Libya. They also highlight areas where Libya has failed to make progress since previous UPR cycles, despite having accepted many similar recommendations in the past.

•Improve the protection of migrants and refugees, end abusive detention practices, adopt an asylum framework, and expand cooperation with UN bodies.

LFJL urges the Court to refer the case to the Assembly of States Parties or the UN Security Council — to uphold the integrity of the Rome Statute and ensure states are held accountable for non-cooperation.
