It's how they handle it. Soldier disobeys order, deeming it illegal, is court-martialed, the court-martial deems the order illegal, and the soldier is cleared. Very reactive, and makes sense in a military setting, but not in a civilian one.

It is stayed for appeal, and that still fundamentally misunderstands the military protocol.

An order, in a military sense, is only deemed illegal upon court martial, which is backward, but is military protocol, secondly.
Should the order be deemed illegal on appeal, and then under the SCOTUS, that still only covers the issue of the order.
