I have no idea what her legal team is telling her, but she seems in denial about the severity of the situation.

They're already down to 2 active attorneys from an original team of 4, and still handling a couple active cases while determined to appeal others. From my understanding every single case has been taken on contingency.
IMHO, they're on borrowed time. I bet they close down late 2026 / early 2027.

If I had to guess it seems pretty pointless to attempt since all 3 Appeals Judges concurred on the ruling. It’s more likely they’ll just head back to the Trial Court and attempt a motion to try and get the case itself dismissed before it actually gets to trial.

Even before the case was put on hold for Appeal, Chloe's team begun to overplay their hand with Special Interrogatories, trying to make the case about GAC as a whole rather than Chloe's specific case. The Judge Denied it.
IMHO, this case is still destined for failure.

The Motion to Compel Further Responses to Special Interrogatories has been DENIED. Chloe's Legal Team was seeking data on ALL patients who sought GAC through Kaiser going back to 2003, inclusive of procedures Chloe never underwent (Phallo).

However as I explained in an article for @assignedmedia.org back when lower court intially ruled to deny arbitration; this is a procedural win that has absolutely zero bearings on the merits of the case. It's one of many hurdles before reaching a jury trial.
