This exactly how fascism always works. They make you feel threatened. They tell you the solution is to stop caring about a particular group of people. They strip those people of their rights. They manufacture another crisis to make you feel threatened. Rinse & repeat. In the end they come for you.
Well the slope from “let the elderly and disabled die of COVID” to “let’s trash all the rest of our ethics, morals and laws” was basically a short walk on a flat path wasn’t it?

Hegseth wasn't chosen as merely a Fox News buffoon who then bumbles his way into war crimes out of machismo incompetence. He was chosen specifically because he is, and has been for a long time, a proud, open, and explicit advocate of war crimes as a good thing we should do.

Essentially without exception, "how panicked are you right now?" correlates perfectly with "how much of a serious person are you?"

A running theme of Trump II is cautious, level-headed, mainstream, career professional experts sounding existential alarms about how we aren't panicking nearly enough.
I know you already know, but for other folks who don't, Goldsmith was previously head of OLC, is a genuinely brilliant mind on executive authority and separation of powers, and is usually very cautious about making claims this unqualified and direct. That he is saying it so starkly is v significant

James Buchanan blew up the Union in defense of slavery and then let his own Secretary of War assist in the lame duck preparations for treason, and Andrew Johnson was a drunken white supremacist who effectively revolted against Congress, and still neither of them were ever so nakedly lawless.
This is the most corrupt, lawless administration in the history of the United States and there’s no close second.

It would be (and has been in some of the other cases) no less murder even if they were drug smugglers, of course. But in this case it's apparent they probably weren't even. They blew up a boat full of people, and then murdered survivors in cold blood, who probably weren't even the claimed targets.

Note the connection with disobeying lawful orders discussions. As @asharangappa.bsky.social observed quite recently, broad presidential immunity was rested partly on beliefs that lower-level officers would disobey unlawful commands.

In fact, the example at SCOTUS oral argument was SEAL Team 6.

In war, ordering your subordinates to kill injured people who are not posing a single threat to anyone is a war crime, as is obeying such an order.
I’m not an expert in the law of war, but an order to kill injured people who were not posing a single threat to anyone would seem to me to be a possible war crime.

This would be an unambiguous war crime even in a proper war against a real enemy’s navy.
