All re-examined decisions issued by the unlawful Chamber of the Polish Supreme Court must be regarded as “null and void.”

BARBARA GRABOWSKA-MOROZ analyses the AW ‘T’ case (C-225/22) as a significant milestone in addressing Poland’s rule of law crisis.

The European Commission dropped its annual Rule of Law report on July 8 — there’s a lot to read and digest. The implementation stats aren’t exactly impressive but dig a little deeper and the picture gets more concerning. A few immediate reflections: 🧵 1/

🇵🇱⚖️🇪🇺 Easily lost in yesterday's news about the landmark CJEU Maltese golden passports judgment is AG Spielmann's opinion on the independence of Polish "neo-judges" in ordinary courts, which has potentially explosive consequences if the Court sides with the AG on this one. 1/

Perhaps the most crucial bit of trivia in this case is that the Polish government is aided in this case by my friend and re:constitution programme fellow @grabowskamoroz.bsky.social who argued pretty much along the lines AG took - great work, Basia! 13/

In opting for this solution, the Polish government has decided against an individual verification of each "neo-judge". This is a mistake, in my view, as I believe Poland is more than capable of reviewing those people in a reasonable time frame. 14/

Orbán is currently the oly EU leader disrupting EU unity, and its clear and strong support for Zelensky and Ukraine. A disgrace for Hungary.
💥Scoop: As EU leaders rally around Zelensky in support, I have obtained this fresh letter from Viktor Orbán to António Costa, threatening to obstruct EU unity in support of Ukraine. As I previously wrote, Hungary is becoming a Trojan horse for Trump after already serving as one for China and Russia.
