Indeed, Defendants openly broadcast that their third-country removal scheme is motivated by an intent to punish Plaintiffs and deter future migration— the traditional aims of punishment. Kansas v. Hendricks, 521 U.S. 346, 373 (1997) (Kennedy, J., concurring) ("We should bear in mind that while incapacitation is a goal common to both the criminal and civil systems of confinement, retribution and general deterrence are reserved for the criminal system alone."). 38. For example, Secretary of State Marco Rubio stated at a cabinet meeting about the third-country removal process: "We are working with other countries to say, 'We want to send you some of the most despicable human beings to your countries, and will you do that as a favor to us?' And the farther away from America the better, so they can't come back across the border."3 Reporting further reflects that spokesperson for the U.S. Department of Homeland Security, Tricia McLaughlin, added: "If you enter unlawfully, you will be removed—and in a way that makes it far more difficult to try again."4
