It says more than that. The President can’t appoint the “first assistant” to be the acting officer if her nomination was *submitted,* not just if it’s *pending.* Withdrawing the nomination doesn’t change the fact that it was submitted:

IF you're working in disinformation, or watch GOP politics, you should read Albert Bandura on moral disengagement. Not only was he a pioneer in social cognitive theory, he won the Order of Canada...
The most obvious moral disengagement strategy going on here (and his other tweets) is Displacement of Responsibility: the assailant isn’t “us,” it’s “them” (and so you shouldn’t feel bad/shouldn’t care). DoR creates distance and removes agency from the action, absolving the need to do anything 2/
