In 1869, Louisiana granted a legal monopoly to a butchering center in New Orleans. The dispute over whether this grant was mainly motivated by sanitary concerns or by corruption & profit led to a defining moment for #SCOTUS and the 14th Amendment.

In #Blyew v US, #SCOTUS invalidated provisions of the Civil Rights Act of 1866 that had allowed federal prosecutions for violent crimes against Blacks, despite states like Kentucky prohibiting Blacks citizens from testifying against white defendants. Basically… “so what?” said the Court.

If you want to be reminded of what really pissed off many white southerners during #Reconstruction, read Chapter 6 of A LESS PERFECT UNION. In response, heavily armed, private right-wing militia groups emerged to intimidate the masses. Sound familiar? #SCOTUS

Sometimes #scotus fools us, especially in deciphering the boundaries between federal and state authority. Other times, #scotus contorts itself into a reflection of the public’s mood, the law and facts be damned.

In US v Rhodes (1868), #scotus deferred to a single Justice acting as a circuit judge.

When the Three-Fifths Compromise ended, the change in population count gave the South 13 more seats in the US House.

Before this turned into Congressional dominance, union leaders pushed through the 13th, 14th, and 15th amendments and several key laws. 14A is still a hot button! #scotus #14A

In his four years as President, Lincoln added five new members to the Supreme Court. He could have gone out of his way to appoint justices committed to Reconstruction and social reforms in the South. But he didn’t… and the country paid an exorbitant price! #scotus #reconstruction

VP Hannibal Hamlin was a committed abolitionist. In 1864 Abraham Lincoln replaced him with Andrew Johnson, a pro-slavery / anti-succession senator from TN. Five days after the Confederate army surrendered, Lincoln was killed and Johnson stepped in—determined to block social reform in the South.

Many (most?) #scotus justices are incapable of rising above their personal biases. Always has been that way. It shows in the Chief Justice’s remarks about slavery in 1857: “That unfortunate race… altogether unfit to associate with the white race, either in social or political relations…” #dredscott
