Over the past 14 months, the Minister of Transportation has amended the Highway Traffic Act FOUR TIMES to arbitrarily and recklessly limit, remove, or ban bike lanes.

Where is the same urgency on opening the Eglinton Crosstown now FOUR YEARS overdue? Ontarians deserve better.

A new report coming to the city’s Infrastructure and Environment Committee (IEC) on Dec 4 is proposing nearly 20kms of new and upgraded bike lanes including Rathburn Rd, Trethewey Dr, and Kingston Rd. All projects SHOULD be Bill 212/60 compliant and free from provincial overreach.

Bill 212 at least pretended it would set criteria for new bike lanes. Bill 60 drops the pretense. Cycle Toronto deputed at Executive Committee to warn about the poison pill that would take power away from people and their communities and give it to cars.

Remember last year when the Ontario government promised they would "unveil a plan to work with our municipal partners around the province" to develop a "common sense, evidence-based bike lane policy"?

Here's their plan: roads are for cars.
Opinion | Ontario’s transport minister: We should only be putting bike lanes in places that make sense Oct. 13, 2024 In short, what we need is a common sense, evidence-based bike lane policy — one that takes all the very real concerns about bike lanes on main streets into account. That’s why, in the next few days, our government will unveil our plan to work with our municipal partners around the province to ensure bike lanes are introduced in a way that reflects the need of the entire community: Cyclists, drivers, transit user and local businesses. Bike lanes are part of the solution when it comes to getting people moving. But here in Ontario — a place where most commuters still drive and where cold winters make cycling impractical for much of the year — we need to be realistic about where they should go. That’s what we’re going to do. Bill 60, Fighting Delays, Building Faster Act, 2025 Prohibition re reduction of lanes 195.3 (1) Except as permitted by the regulations, a municipality shall not, by by-law or otherwise, reduce or permit a reduction in the number of marked lanes available for travel by motor vehicles on a highway or a portion of a highway under the municipality’s jurisdiction and control for any of the following purposes: 1. A bicycle lane. 2. Any other prescribed purpose.

Cycling advocates upset over changes to bike lanes Cycling advocates are also raising concerns about the bill, saying this is the fourth time the Ford government has attempted to micromanage the placement of bike lanes under municipal control. Bill 60 would essentially act as a ban on new bike lanes across the province if they remove a lane of vehicle traffic, said Cycle Toronto executive director Michael Longfield. “It's effectively blocking municipalities from making any progress with cycling network plans,” Longfield said. “And that's not just Toronto — it's across the whole province.”

This is another gross jurisdictional overreach from a government that feels no shame peddling false statements.

Doug Ford’s Toronto is a shortcut for cars to drive through unimpeded, not a city of vibrant communities where people live and thrive.
This is further proof that any claims this time last year that the Province of Ontario intended to collaborate with municipalities on data-driven decisions to keep people moving were never sincere,” said Michael Longfield, executive director of Cycle Toronto. “This is a government wasting your tax dollars by doubling down on a bad-faith culture war that will only make congestion worse while putting people’s lives at risk. For folks frustrated driving in our cities, Doug Ford knows you’re not stuck in traffic because of bike lanes. Where is the same focus and intensity from the province on real solutions like opening the endlessly delayed Eglinton Crosstown LRT?” In plain English, Ford’s government is once again trying to handcuff cities and erase years of progress on making roads safer and more livable. There are very few safe and separated bike lanes in Toronto that didn’t require a road reconfiguration of some sort given the streets were designed decades ago.

Bill 212 wasn't enough. Now the Government of Ontario plans to handcuff municipalities from making meaningful decisions about their roads and block the construction of any new bike lanes that would involve road reconfigurations. Read more:

Globe and Mail: Residents in Kapuskasing, the town northwest of Timmins where a pulp mill shutdown threatened thousands of jobs, before a possible government lifeline emerged this week, may reasonably want the premier to spend less time and political capital on removing bicycle lanes in downtown Toronto. Drivers who want investments to make dangerous rural highways safer may wonder at a transportation policy so laser-focused on banning urban speed cameras. And residents province-wide may question why they should pay for the spa at Ontario Place.

Despite all your submissions, disappointed Council adopted the item without debate. With new cycling projects not moving forward and previous approvals put on hold, the (already modest) planned progress of Toronto's cycling network is at risk of being set back a decade.

Our submission opposing any delays implementing the Sheppard Complete Street. We cannot let fear or uncertainty of provincial bullying block our progress. Not moving forward with the Cycling Network Plan by the City effectively hand Council's own power to the Premier and undermine its authority.
Dear Councillor Carroll, Mayor Chow, and members of City Council, Re: MM33.5 - Protecting Public Investment & Advancing Interim Solutions Along Sheppard Avenue East We are writing to express our strong support for completing the Sheppard Avenue East Complete Street project as originally approved by City Council in June 2023. We urge you to reject MM33.5. There is currently nothing in the Province’s Bill 212, Reducing Gridlock, Saving You Time Act, 2024 that blocks the City from moving forward with the Sheppard Avenue East Compete Street or any cycling infrastructure project, even those involving lane reconfigurations (though the majority of this project would not). Toronto is not a “prescribed municipality”, and to date no regulations have been issued requiring Ministerial approval: (3) Subsection (1) does not apply to a municipality in respect of a bicycle lane if, on the day the municipality is prescribed for the purposes of subsection (1), a contract has already been awarded or entered into for the construction, installation or marking of the bicycle lane or, if the construction, installation or marking of the bicycle lane is to be done by the municipality and not by any party under contract, such work has already commenced. Cycle Toronto’s recent legal win challenging the constitutionality of the Province’s attempt to remove and reconfigure the bike lanes on Bloor, Yonge, and University makes clear that the underlying legislation is arbitrary and reckless. Bundling these improvements on Sheppard with planned road work is a once-in-a-generation opportunity for North York. We cannot let fear or uncertainty of provincial bullying block our progress. Any delays to the approved Cycling Network Plan by the City effectively hand your power to the Premier and undermine your authority. Michael Longfield Executive Director

Last week we deputed at Infrastructure and Environmental Committee (IEC) about the challenges of micromobility enforcement, and urged the city to instead focus its priorities and resources on eliminating deaths and serious injuries caused by drivers.

Minister approval for bicycle lanes required 195.3 (1) In the circumstances described in subsection (2), a prescribed municipality does not have the power to construct, install or mark a bicycle lane on a highway or part of a highway under its jurisdiction and control unless the design for the bicycle lane has been approved by the Minister and, in considering whether to give such approval, the Minister may require information from the municipality including traffic information relating to the design for the bicycle lane and the highway.

ICYMI back in September more than 100 people joined our Rally and Ride for Eglinton demanding the City deliver on its commitment to build bike lanes Eglinton now. Delaying will drive up costs, disrupt traffic twice, and risk provincial interference under Bill 212.
