Jury or no jury that is the case. Juries are not involved in sentencing so judge's sentences are unaffected.

What do we know of the track record of juries? Every miscarriage of justice in history was signed off by a jury.
Lack of a constitution & the persistent attack on human rights law is a concern, with or without juries. As I say, the little insight available on jury deliberations is not encouraging.

Certainly judges could have done a better job but they were not the central villains of the piece.
As it occurred with jury trials I can't see how this pertains to the jury/no jury debate.
In terms of 2 tier issues, that judges in a min of the PO cases were insufficiently inquisitive isn't central.

The "supposed to be" was misleading statements from the gov who either didn't care or didn't understand what their law would mean in practice.
It is standard for govs to play up or play down the impact of new legislation to suit their interests.

Of course they were all jury trials. This isn't a case to rest arguments about 2 tier justice on.
It's a unique case, at least in respect other organisation don't have the prosecution powers of the PO. Failings were apparent across institutions & corporations. Fujitsu have not been held to account.

The responsibility for this lies with the "law & order" rhetoric of the Blair government. They passed inhumane, draconian & oppressive legislation on the back of reactionary speeches in a bid to win votes. Not fully shut down as there are people still serving those sentences.

Not sure I would miss a jury were I on trial. Accounts from friends & family who have been jurors don't paint a pretty picture. Reports were consistent with a TV doc I watched in which they simulated a court case & followed the jury discussion.
Long & short of it was jurors prejudices running wild.

You are listing things that are not at the door of the judiciary. IPP sentences were not the creation of judges, they were a legacy of the last Labour gov.
