But a service provider might be liable if it loses safe harbor, and the job of the Court in this case is to say when that is. Given Section 512(l), what more is required for secondary liability beyond falling outside the safe harbor? 2/2

Like some of the Justices in today’s oral arguments in Cox v. Sony, Ars doesn’t have a handle on how secondary ©️ liability works. The DMCA creates defensive safe harbors, not affirmative legal obligations. Losing safe harbor =/= being liable. The DMCA says so on its face in Section 512(l). 1/2

The Google et al. amicus pointed this out at length at pp 14-16. But knowledge is sadly water under the bridge in this petition, so it was frustrating to see it focused on in such a big way during the argument. The issue is what counts as material contribution.

Weird twist is that she and her husband had already sold the land, under threat of eminent domain, for a 2005 semiconductor fab project that never came to fruition. She and her husband (who died in 2015) got something like a life estate on a 3+ acre tract as part of that earlier deal.
