Which brings us back to Kim Kardashian. The bar exam isn't failing Kim Kardashian. It's failing the law school graduates who more than meet any reasonable standard of "minimum competence" because the test is administered as a quantity control mechanism for the profession. But Kardashian isn't a law school graduate who completed a course of study at an accredited institution. She's the exact reason the public thinks a test like the bar exam is necessary in the first place. Kill the bar exam tomorrow, replace it with statewide supervised-practice pathways, tighten accreditation oversight, and give diploma privilege to schools that produce actually competent graduates. Then reserve the exam - a better one, not the dumpster fire we have now - for the narrow slice of candidates not covered by those systems.

No, being a lawyer is not the same as running a bar. An incompetent lawyer leaves clients in financial ruin or prison, while an incompetent bartender leaves clients with a subpar martini. The free market can sort out bad bartenders over time, but it doesn't do much for the guy serving 25 to life while the rest of the market catches up on the lawyer's Yelp reviews. Many jobs don't require expensive licensing. Attorney is not one of them.

So now we loop back around. The use of inflatable costumes in protest has been applauded by many commenters in the don't-give-him-what-he-wants camp, held out as a shining example of how to protest "right," in a way that doesn't give Trump an "excuse" to federalize the Guard. Unfortunately, in the veritable seat of the Inflatable Protest Movement, it turns out that Donald Trump and his judges don't give a fuck how people are protesting, and will say that flashlights shining in the very scared ICE agents' eyes is enough to justify a military presence. There is no form of protest that will protect you from an authoritarian deciding to be authoritarian. We would all be far better served by showing up in whatever capacity feels right to us, and refusing to police other protestors. Policing protest not only harms solidarity-building, it accepts a false premise: that there is a "wrong" way to protest your government disappearing people to uncertain fates. 9 I've noticed an additional troubling trend in discourse, which is people responding to my statement that we should not police protest in this moment by saying that they "disagree" with me because they support nonviolent protest. I, too, support (and exclusively engage in) nonviolent protest, and arguing that we should avoid policing allies as they figure out how to resist an authoritarian state is not a call for violent protest. This response speaks to a deeply engrained desire to police oneself and others

I appreciate this characterization of the Republican Party from Public Notice today in the article on the success of the No Kings protest. Essentially, they’re trolls. No principles, yes power.
The Republican Party has increasingly come to define itself by what and whom it hates. If some new issue bursts into public awareness, they won't know what they think until they find out what position Democrats were taking so they can take the opposite one. They're anti-anti-racism, and anti-anti-climate change, and all it takes to get them to denounce something is to tell them liberals like it. They'll even get worked up about a corporate logo if a bunch of bots tell them it's woke, apparently because the Founding Fathers would never have stood for sans serif fonts. So calling this event (and the larger movement it seeks to create) "No Kings" turns out to have been a stroke of genius, because Trump's response was to essentially say Yeah, I'm the king — and because I'm the king, I can poop on people! After so many years one would think he had lost the ability to shock, but no - generative Al slop tools give Trump a whole new way to act like a petulant toddler.

He never apologized. After Paul Pelosi was attacked Fox News hosts joked about it on air. They weren't fired. They never apologized.
