Rainbow Road probably is a private race track, which means Mushroom Kingdom NHTSA would be unlikely to have jurisdiction. However, in the upcoming open world Mario Kart, they’ll be taking motorized vehicles on public roads, which would absolutely qualify for NHTSA oversight.
