Can anyone verify or rebut this?

This petition should be dismissed on that basis alone. Some context that may be helpful. Near the end of 2024, the PPB ceased collection of Automatic License Plate Reader (“ALPR”) data. The vendor of the hardware and software ended its support for the ALPR program. Due to its first vendor’s obsolescence, PPB has since searched for new vendors, and had a trial pilot program where it collected ALPR data from April 2025 to July of 2025. Beyond that, the City simply does not have any ALPR data/records for September 17, 2025. Mr. Kessler’s arguments regarding bad faith and illegal withholding of records are therefore meritless and inapplicable. CONCLUSION The City conducted a thorough search and no responsive records exist. As such, the City asks that Mr. Kessler’s petition be dismissed. Letter from Dan Ryan Dear Portlanders, Let’s be honest. Like many of you, I’ve been reflecting on President Trump’s decision to send the military to Portland. At the same time, I have been taking an objective inventory of the current state of our city. This I know is true: We don’t want to live in a country where the President sends in troops against the wishes our federal delegates in Congress, Governor Tina Kotek, Mayor Keith Wilson and local elected officials—of which I am one. Let me be clear. Deploying troops to displace local law enforcement is an extreme federal overreach that threatens our local autonomy. The federal administration was looking for a fight to justify its claims about our city being unmanaged. This path leads to violence, stronger federal intervention, and ultimately justification of the federal overreach. So here we are. This is not new to us. We were in similar scenarios in 2016 and 2020, and how we handled ourselves at those times has made a permanent imprint on Portland’s reputation. We can act with reason and purpose without tearing this city up. We must also admit that all is not perfect in Portland. Our economy is struggling with historically high vacancy rates and rising unemployment. We have a humanitarian crisis on the streets that has become enabled and normalized. We need to address intolerable and illegal actions in our community, like open drug use, vandalism, violence, and theft. Portlanders rightfully expect us to get our house in order. This is one of the members of Oregon’s Public Records Advisory Council explaining in response to a records request that, in the year 2024, “data loss is possible if not likely” when sending half-gigabyte (uncompressed) text files over the internet.
the County would need to set up an account for you on the server. To do this, we would need to you to again confirm your IP address to enable a connection from your computer. It could take a number of days for our IT folks to complete this work, which means that if you elect to have the data provided to you via the external FTP site you would likely not be able to download that data until sometime next week. In addition, the responsive records on the jump drive are large files -- ~100 MB for the smallest file and ~521 MB for the two largest files. Data loss is possible if not likely when files that large are transferred over a network, such as for delivery via FTP. Given the above issues, please confirm that you would like the County to start work on creating the FTP account for delivery to you via that means. Thinking about that time a Multnomah County attorney accused me of violating the attorney ethics rules by destroying my client’s documents and thus failing to safeguard my client’s property.

This concerned a matter in which I was my own client.
Excerpt from letter: iv. Accordingly, if the County was in fact required to provide Mr. Kessler with copies of all the Responsive Records he received under the SPO, rather than only the redacted version of the record he previously did not receive, then the County’s assumption was reasonable that he still retained copies of the record based on Mr. Kessler’s participation in Multnomah County Circuit Court Case No. 22CV42753 as plaintiff and plaintiff’s counsel as retention of the records was required under professional rules governing Mr. Kessler’s practice. My client sued Multnomah County Animal Shelter for their habit of punishing volunteers who speak out by firing them THEN banning their loved ones from the foster program. Now the government is demanding that she reveal all of her memberships.

I thought we already did this in the 1950s.
