And frankly, if we’re talking about influencing the military, we can certainly say that the video reminding service members they must refuse illegal orders (like being told to fire on shipwreck survivors) is still firmly intact. That’s not disloyalty; that’s literally military law.

It’s also an outdated “sedition-era” statute that modern First Amendment standards have shrunk down to a toothless relic. Its usable scope is basically nonexistent.

Courts have been clear: the First Amendment protects criticism of military operations, criticism of the president, anti-war speech, whistleblowing, and protests, even the loud, uncomfortable ones. You cannot jail people for political disagreement, no matter how much a president might wish otherwise.

Here’s why this will go nowhere. The law he’s waving around, 18 U.S.C. § 2387, only applies if someone knowingly and deliberately tries to undermine the loyalty or discipline of the military. It doesn’t apply to criticizing the government, a war, or a political leader.
