To this non-lawyer, it seems bizarre that "war-torn," "anarchy," "insurrection," etc. can be essentially defined by POTUS. In short, it seems that he--and it's always a "he"--can simply declare a city is crime-ridden and then call in federal troops, regardless of the actual facts on the ground.

And although there is a procedure to seek *full* en banc rehearing (what we called "super en banc" when I was clerking), that procedure has never successfully been invoked.

The 10 judges are drawn from the pool of all non-recused active judges and any senior judges who were on the panel and wish to be eligible (so, Judge Graber would presumably be in the pool here).

Among other things, that means the "en banc" court could easily skew to either side of the split.

If so, then *10* judges are randomly drawn to sit with Chief Judge Murguia as the "en banc" court.
