In other words: Texas is deputizing some of its state officers to act as roving ICE agents.

U.S. Robert Gettleman is now giving his thoughts. He says, "I think the evidence has been pretty strong that this facility is no longer just a temporary holding facility. …

"It has really become a prison."
DOJ's Jana Brady steps up next but says she'll largely "rest on our brief that we filed."

She wants any TRO to not "interfere with the executive branch."

The Supreme Court just cleared the way for racial profiling during immigration raids and sweeps.

This means the Trump administration could rapidly expand its plans for law enforcement to harass people based on their skin color, the neighborhood they live in, or the language they speak.

🚨 SCOTUS just greenlit racial profiling in immigration arrests. No majority opinion—but the impact is clear: immigrants and U.S. citizens of color are at risk.

Kavanaugh’s concurrence ignores the evidence & tramples the 4th Amendment’s requirement of individualized suspicion:
🚨 Today the U.S. Supreme Court rubber stamped EXPLICIT racial profiling during DHS immigration raids. This green lights the worst ICE & CBP practices we are seeing against Latino communities around the country. We can expect this racist enforcement to expand rapidly.🚨
🚨The Supreme Court today gives Trump a license to engage in racial profiling, with Justice Kavanaugh writing in concurrence to expressly endorse ICE and Border Patrol targeting any Latinos they observe in Los Angeles speaking Spanish and then demanding their papers.

Immigrant youth fought to win DACA. For years, we fought to keep the DACA program open and came together to defend DACA recipients from attacks. As these kidnappings continue to increase, we must remember that when we come together, we win!

Constitutional rights are use-it-or-lose-it. Every person who refuses unlawful questioning forces agents to either respect legal boundaries or reveal they're ignoring them. Your citizenship doesn't obligate you to make ICE's job easier—it obligates you to make them do it legally.
If you have US citizenship, do not help ICE by telling ICE about your citizenship. Just refuse to talk to them. Refuse to answer their questions. Turn on your phone and run away from them. If they're wasting their time profiling you, you're saving the lives of people who ICE really wants to profile.

Great blog by @naynagupta.bsky.social discussing the lack of standards in assessing gang affiliations and the near total inability to contest them in the immigration system. This has allowed the Trump admin to transfer 238 Venezuelans to a Salvadoran prison by presenting almost no evidence.
I wrote a piece for Just Security on the history of flimsy & sham gang allegations in the U.S. immigration system. 👇🏽
On the #AlienEnemiesAct case and more.

@naynagupta.bsky.social writes about the “long history of immigration agencies using tattoos and a set of notoriously flawed gang databases to bring false or weak claims of gang involvement.”

Trump’s DOJ knows it can’t win the birthright citizenship cases on the merits, so it’s trying to use a procedural issue (that #SCOTUS has repeatedly dodged) to put the policy into effect across much of the country.

Today’s “One First” looks at the cynical ploy:

133. Birthright Citizenship (Sort of) Reaches the Court
The Trump administration's emergency applications in three birthright citizenship cases are a cynical effort to mitigate the effects of an inevitable loss on the merits. The justices shouldn't bite.

Today, Congress passed a spending bill that includes even more funding for detention and deportation. Congressional leaders should invest in programs that strengthen communities and support families.

Instead, they're spending tax dollars on ICE and family separation.

Nearly 700 communities in 32 states plus Washington, D.C. could be deemed as “sanctuary” under H.R. 32 and would be at risk of losing federal funding for critical programs that serve everyone, including both noncitizens and citizens.
Efforts to penalize so-called “sanctuary cities” are back. Congress is considering a bill—H.R. 32, the No Bailout for Sanctuary Cities Act—that would allow a president to strip cities, counties, and states of critical federal funding.
