Trump's proposed executive order on elections is flatly illegal & unconstitutional. Presidents have no lawful role in running elections. Only the states and Congress do. Courts have already rejected his prior elections EO on this basis. This claim of authority to take over elections is chilling.

The court’s ruling does, however, seriously weaken the tools available to federal courts to enforce adherence to the law. In that way, it has emboldened executive abuse of power.

At some point, Congress will need to fix this and all the other messes this Court has created.

FIRST OPINION: TRUMP V CASA

Court grants Trump's request to narrow the injunctions against his birthright citizenship EO

Stepping back, it is very disappointing, to say the least, that the Court went out of its way to weaken the tools available to the Courts to rein in abuse of power at a time of unprecedented threat to the rule of law.

But it also left open other avenues for litigants to get broad and even nationwide relief against unconstitutional government actions. I expect litigants will fully avail themselves of those avenues quickly to enforce citizenship rights.

The court’s ruling does, however, seriously weaken the tools available to federal courts to enforce adherence to the law. In that way, it has emboldened executive abuse of power.

Note that SCOTUS did not disturb the injunction prohibiting the enforcement of the EO as it applies to the parties to the lawsuit. There is nothing to suggest it
disagreed with the lower court’s ruling that the EO is unconstitutional.
