The EHRC code must be scrapped.

Our Head of Policy, Jess O'Thomson, says that in light of this significant intervention, the Code of Practice cannot be laid as drafted. The Minister must reject it.

Exclusion of trans people from services for their lived gender must be the exception, not the rule.

The Commissioner makes it clear that any new guidance has to explain how to include trans+ people.

Not doing this leaves the UK at risk of breaching its international human rights commitments.

It's a strong, detailed, and thorough letter – but it makes clear that the UK is on a path to widespread trans exclusion, in potential violation of trans people's human rights.

The decision now is Bridget Phillipson’s. She can send this draft back, and demand better. Any new code must make clear how providers can remain trans-inclusive.

The EHRC has sent their draft Code of Practice to the government. It seeks to mandate the blanket exclusion of trans people, from toilets to book clubs.

We are at Labour conference, telling members about the impact of the proposed bathroom ban. It would devastate trans people’s lives, create unworkable business challenges, and alienate voters.

This would be Labour’s legacy on LGBT+ rights for a generation. But it’s not too late for them to stop it.
