4/ The next battle is likely to take place in Parliament, and we need to ensure the draft Code is rejected. We should start spreading the message and tell MPs that the EHRC is pushing for a vote. I mean they just released a video acknowledging that our sovereign Parliament has the final say. 🤭

3/ The harm caused via the EHRC has been vast, yet there appears to be no prospect of compensation. Those responsible for this reckless conduct remain in legal practice as barristers; one has even been promoted from entry-level lecturer to professor. We should hold them accountable, shouldn’t we?

2/ I think most public law lawyers understand that it’s difficult to find a solid “anchor” to challenge the underlying legal position in court. That said, I also believe we’ve already gained most of the benefit from legal threats, as they have clearly influenced the EHRC’s institutional behaviour.

1/🧵 I should note that from the beginning, I knew the EHRC would withdraw their “interim update” guidance.

My aim was to make it untenable for them to defend the position that segregation of trans people is mandatory. And I think that strategy has been successful.

That doesn’t mean we can stop.

1.5 years after I made the Cass Review freedom of information requests, I still don’t know whether it was an individual, a business, a body corporate, a corporate sole, an inquiry, or the Crown.

Perhaps I should just call it, in accounting terms, a going concern.

There isn’t a strict rule here. It’s at the court’s practically unbridled discretion whether the case can go forward. And, because this case is so special, it depends on whether the judge thinks it’s an interesting intellectual challenge.

The EHRC has finally, five months after producing its wildly transphobic and, we believe, unlawful Interim Guidance now taken it down. Our judicial review challenge to that Interim Guidance will be heard in less than one month.

New Zealand doesn’t have a First Amendment — we have Parliamentary sovereignty and NZBORA. Our Parliament banned conversion therapy because it harms people. If Stephen Franks wants US-style “freedom” to abuse LGBTQIA+ kids, he can move there.

Absolutely, this dude utterly sucks!
Many will know a parent who may be doomed to this desperate state - with no way out. Even if they’ve  only permitted or aided their innocent child’s groomers without authorising surgery or drugs, some will be haunted. Can they undo the harm? Could they have prevented it? 

My firm is trying to help a number of parents who are doing all they can while they can to protect their deluded children. 
It is an outrage that the Parliamentarians who passed the conversion therapy ban, despite its direct conflict with freedom of speech, are tolerating the prevarication of Minister Doocey over dangerous ‘gender-affirming’ hormone ‘therapy’ for children

The US Supreme Court is likely to invalidate conversion therapy bans shortly, as contrary to the First Amendment (freedom of speech).
