Microsoft now have to explain what data gets used in “business modeling” & “energy efficiency”, if personal data was sent LinkedIn, OpenAI or the tracking company Xandr, delete personal data gathered using the tracking cookies, and provide adequate access to individuals' data

Microsoft tried to shift responsibility to their Irish subsidiary, but that didn't work either - with the DPA finding that minor changes made in Ireland are not enough to shift responsibility and - importantly - jurisdiction to Ireland.

The DPA found that Microsoft:

🍪 used tracking cookies without consent
🍪 did not provide full access to information about user's data

And when students tried to exercise their GDPR rights, nobody would give them a straight answer.

The Austrian DPA has ruled that Microsoft 365 Education used tracking cookies without consent — illegally collecting student data - following a complaint supported by @noyb.eu

In short, this judgment is a huge win. It tells companies like Clearview that they are not allowed to do what they want with our personal data and then use it to undermine our privacy.

Law enforcement exemptions and loopholes are regularly seen in data protection laws, but that doesn't mean companies working with law enforcement are automatically off the hook when it comes to our rights.

The tribunal also made clear that Clearview’s activities involve 'behavioural monitoring' and so they couldn't escape GDPR.

That's an important finding - especially as we see more use of AI and biometrics to track people on - and offline.

Clearview tried to argue that their activities were outside of the scope of GDPR, so it didn't apply to them.

The ICO & PI challenged this and the court agreed with us on our interpretation, citing certain of PI's arguments as being persuasive.
