Yes, the EHRC are a lost cause.

I don't know that they can do much about the GLP case. It's fairly clear the interim update was an over-reach, and in the initial hearing the EHRC lawyers could not justify the position. The judge didn't seem impressed. But maybe they can cook something up. 🤷‍♀️

We are also bound by the Human Rights Act to make judgments that least contravene the Convention articles. The SC completely failed to even consider these. They makes some allusion to the GRA essentially satisfying Goodwin/ECHR, without justification and counter to previous SC judgments.

I am just speculating, mostly, but if I wanted to remove human rights from a group, I would want to do it subtly so that people don't notice and to do it quietly, so without big noisy legal challenges. The EHRC have not helped by essentially handing them a live grenade, so they need to be sneakier.

I also think that waiting for the JR at least gives them a get out clause. I presume some people in Government (the AG, probably) have pointed out that the guidance is, at best, problematic or legally controversial.

They can try to minimize negative press by sending it back to the EHRC post JR.

Moreover, to my non-lawyer mind, it is written in such a way to suggest that ‘trans inclusive’ policies must be fully inclusive, which I think is more problematic.

There are certainly issues around freedom of association for groups that need careful thought.

My understanding at the very least is that it should be a consideration.

The EHRC could argue that their guidance is strictly correct because it doesn’t *mandate* single sex spaces.

It does however imply things like toilets & changing rooms always must be single sex, which is not what Croft said.

If I recall correctly, the Minister’s response to the GLP review said that if it went to a full hearing, they would submit something.

So perhaps they are waiting for that and to see how the legalities fall in November.

I do not believe an Education Minister who thinks it is a good idea to usher in a new Section 28 is steadying any ships or has a record of delivering anything other than misery and suffering for some of the most marginalized.

The trailblazing transgender rights activist Miss Major has passed away at the age of 78.

Miss Major was a lifelong organizer and participant in the ballroom scene. She took part in the 1969 Stonewall Riots and was injured by the police — but she kept fighting.

If you're feeling optimistic, it gives them a get-out-of-jail free card if the JR highlights legal issues with the draft. If you're feeling pessimistic, they'll rig that one too.

I'd be somewhat surprised if they weren't waiting to see what comes up in the judicial review in November. It's not that long away and they would want to avoid something embarrassing coming up.

Alice’s death got coverage because my family sought press attention to highlight the appalling state of trans healthcare.

I've always enjoyed 'The Catcher in the Rye'. At school, our English class was the only one who studied it over 'To Kill A Mockingbird', because the teacher couldn't stand the latter. I am glad we did, because 'Catcher was a type of book I had never seen the like of before.
