Good morning. Despite the ongoing shutdown, U.S. Magistrate Judge Gabriel Fuentes wrote in a minute order Monday that his "understanding as of today is that jury trials will proceed as scheduled" at Chicago's' fed courthouse.

U.S. District Judge Sara Ellis betrayed no reaction to the answers from Kyle Harvick or Shawn Byers today. It's really hard to tell if she's satisfied, frustrated or what.

Now she's having a discussion with the lawyers about evidence gathering (discovery).
Ellis comes back and asks who the highest commanding officer would be for ICE in Chicago.

Byers says it is now Sam Olson. Before last Friday, it would have been Russell Hott.

And that's it. Byers is done.

Ellis is also allowing the plaintiffs to depose former ICE Field Director Russell Hott and Deputy Chief Patrol Agent Daniel Parra.

The depositions are all limited to two hours.
