I'll take as many never-Trump republicans as I can get.

That is an interesting editorial question!
alanrozenshtein.com
I have no problem if people want to append a "To be clear, Shapiro is himself no defender of free speech" to criticisms of Georgetown's conduct.
alanrozenshtein.com
I have never claimed he's a supporter of free speech! Just that, in that specific instance (and perhaps in the NYU case, depending on how the facts shake out) supporting his speech is supporting free speech.

Yup, definitely better and more important. But, again, she's a conservative so this (understandably) annoys her as well and the big ticket stuff has been talked about a lot already!

I am very open to that critique of the op-ed!

I've never met Shapiro and have zero invested in defending (or attacking) him personally. But it's still crazy to me how hard it is for people to just say that Georgetown acted badly and that's the story. To his enormous credit, David Cole saw things clearly. www.nybooks.com/online/2022/...

The controversy surrounding conservative lawyer Ilya Shapiro’s future at Georgetown University Law Center threatens to turn academic freedom on its head.

He was not fired, but on a technicality (because he was not an employee yet) and the report made clear that, if he spoke out similarly in the future, he might well be fired. His employment was completely untenable.

And one concern I have is that many of my colleagues (in the broad sense) will use the far bigger and more acute threat from Trump to let themselves off the hook for fixing that problem, which is, although not the biggest problem, still a problem! Hence my more positive reaction to the op-ed.

For my own part, I am not a conservative, but I think that academia has in many ways behaved terribly on free speech over the past decade.

One can disagree with her assessment of what happened at NYU (you and I disagreed on that, which is fine) but I think her broader project is perfectly legitimate.

And she views NYU canceling/rescheduling the Shapiro event as really bad, which makes sense given that she's very conservative. So she's writing an op-ed reminding the left that, even though Trump is bad and is an acute threat, they still have to get their house in order.

But it's easy to be courageous when it's in line with your political priors and social expectations. But she's much more conservative than her audiences. And it irks her that they're all nodding along but not (in her view) being courageous in the way they can be—i.e., on the issue of free speech.
alanrozenshtein.com
Out of context absolutely non sequitur. But FWIW here's how I read the op-ed: Danielle did a courageous thing (I think everyone agrees with that). And so lots of schools are (correctly) inviting her to talk about that courageous thing.
alanrozenshtein.com
I don't think one has to take a position on whether Shapiro is a friend or foe to free speech to think that his treatment, both originally at Georgetown and since then on at least some campuses has been shameful and contrary to free speech values.
alanrozenshtein.com
I'm inclined to cut her some slack given what she did in SDNY. At the end of the day she is a conservative and has conservative preoccupations.

Also I don't think she's saying that it's the point of her story in toto, but rather for the the university audiences she's trotted in front of.
alanrozenshtein.com
I don't think she's saying they're the "real" problem, just that they remain a (secondary) problem.

Please help me get the word out about the new websites for Legal Theory Blog and the Legal Theory Lexicon. Reposting here and on other social media sites is great. It would be especially helpful if law school faculty members could send an email to their colleagues with the new addresses.

The loudest of the anti-AI crowd here was always what it is, and that's a shame. Recently some bigger accounts have allowed themselves to become so negatively polarized by them that they basically exist to dunk on the lowest hanging fruit, and that's a shame too.

That’s also very bad!
